Welcome to Brocr — a product by I-engage (“Brocr”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of the Brocr mobile application, website, and related services (collectively, the “Platform”). By accessing or using Brocr, you agree to be bound by these Terms. Please read them carefully before using the Platform. If you do not agree, you must discontinue use immediately.

1. About Brocr

Brocr is a digital platform designed exclusively for real estate brokers, consultants, and agencies in India. It enables users to manage listings, generate verified enquiries, collaborate with team members, track performance, and simplify their business operations — all within one app. Brocr is operated and owned by I-engage with its registered office at: Navneet Plaza, 5/2, 302, Greater Kailash Road, New Palasia, Indore, Madhya Pradesh 452018, India.

2. Eligibility

To use Brocr, you must:
  • Be at least 18 years of age;
  • Be legally capable of entering into a binding agreement;
  • Operate as a real estate professional, consultant, or broker in compliance with applicable laws and RERA regulations.
By registering, you confirm that the information provided is accurate, complete, and up to date.

3. Account Registration and Security

  • You must register for an account using your valid name, email address, and mobile number.
  • You are responsible for maintaining the confidentiality of your login credentials and any activity under your account.
  • Brocr reserves the right to suspend or terminate accounts that engage in fraudulent, abusive, or non-compliant activities.
  • You must notify us immediately at info@brocr.in if you suspect unauthorized use of your account.

4. Services Offered

  • Enquiry Generation: Verified and exclusive enquiries for your listed properties.
  • Property Listing: Upload and manage property listings with photos, descriptions, and pricing.
  • Wallet System: Secure prepaid wallet for campaign top-ups and Enquiry purchases.
  • CRM Tools: In-built Enquiry and task management system for brokers and teams.
  • Open Market Access: Option to share or sell properties listed by other verified brokers.
  • Analytics: Reports and performance metrics to track ROI and growth.
Brocr continuously improves and updates its services; new features may be introduced without prior notice.

5. Payments and Wallet Usage

Brocr operates on a prepaid wallet system. Users must top up their wallet to purchase enquiries, activate campaigns, or unlock premium features.

  • All payments are processed securely through authorized payment gateways.
  • Wallet balances are non-transferable and non-exchangeable.
  • Refunds are available only under specific circumstances as per Brocr’s Refund Policy.
  • Brocr reserves the right to modify pricing, Enquiry costs, or promotional offers at any time.

6. Use of Platform

  • Upload false, misleading, or inaccurate property information;
  • Misuse or resell enquiries, contact details, or confidential data obtained through the app;
  • Use automation tools, bots, or scripts to extract data or manipulate the system;
  • Infringe upon others’ intellectual property or privacy rights;
  • Attempt to breach or test the security of the Platform.
Violation of these Terms may result in account suspension or legal action.

7. Data Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using Brocr, you consent to the processing of your data as described therein.

8. Intellectual Property Rights

All content, design, logos, graphics, and software on the Brocr Platform are the exclusive property of I-engage. You are granted a limited, non-transferable, and revocable license to use the Platform for your personal or business use in accordance with these Terms. You may not copy, modify, reproduce, or distribute any part of the Platform without prior written consent from Brocr.

9. Enquiry Ownership and Confidentiality

  • enquiries provided through Brocr are exclusive to the user who purchased them.
  • Sharing or reselling Enquiry data to third parties without permission is strictly prohibited.
  • Brocr verifies and delivers enquiries using best practices but does not guarantee conversion or specific business outcomes.
All user data and communications are handled in accordance with our Privacy Policy and applicable data protection laws.

10. Content Responsibility

Users are solely responsible for all information uploaded, including property details, photos, and marketing content. By submitting content, you grant Brocr a license to use it within the Platform for display, distribution, and marketing purposes. You confirm that you have all rights, permissions, and authorizations for any content you upload.

11. Third-Party Services

Brocr may integrate with third-party platforms (e.g., Google Ads, Meta, WhatsApp, payment gateways). We are not responsible for the functionality, reliability, or privacy practices of such third parties. Users are encouraged to review their respective terms.

12. Limitation of Liability

  • Brocr shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Platform.
  • We do not guarantee Enquiry conversion, business outcomes, or uninterrupted access to services.
  • In no event shall Brocr’s total liability exceed the total amount paid by you in the preceding 3 months for services rendered.

13. Indemnification

You agree to indemnify and hold harmless Brocr, I-engage, its affiliates, officers, and employees against any claims, losses, or damages arising from:
  • Your breach of these Terms;
  • Your misuse of the Platform;
  • Violation of any law or third-party rights.

14. Suspension and Termination

Brocr reserves the right to suspend or terminate access to any user who violates these Terms or engages in activities that may harm the platform’s integrity or other users. Upon termination, your license to use the app shall immediately cease, and all pending obligations shall survive termination.

15. Modifications

We may update or amend these Terms at any time. Updates will be reflected within the app and on our website. Continued use of the Platform after such modifications constitutes acceptance of the revised Terms.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Indore, Madhya Pradesh.
